How to Object to a Customs Fine in Turkey: 15-Day Deadline & Litigation — 2026
Administrative fines imposed by customs authorities during import or export transactions are a common issue in commercial activity. Objecting within the legal deadline is critical to avoid losing your right to challenge the fine.
How Long Do You Have to Object to a Customs Fine?
Under Article 242 of Customs Law No. 4458, customs duties and administrative fines can be objected to before a higher authority (or the same authority, if none exists) within 15 days of notification. Even if the objection petition is filed with the wrong authority, it is still deemed filed on time — the authority is required to forward it to the competent one.
How Long Does the Authority Have to Decide on the Objection?
Objections received by the authority must generally be decided and notified to the party within 30 days. If no response is given within this period, the objection may be considered implicitly rejected.
Can You File a Lawsuit If the Administrative Objection Fails?
If the administrative objection doesn't succeed or isn't answered in time, you can file an annulment action against the customs duty/fine before the competent tax court. The filing deadline starts running from notification of the rejection (or the expiry of the implicit rejection period) — it's important to track the objection process closely so this deadline isn't missed.
Is the Administrative Objection Mandatory?
The administrative objection route under Article 242 of Law No. 4458 is generally treated as a precondition that must be exhausted before filing a lawsuit directly. Skipping this stage and filing a lawsuit directly can risk the case being dismissed on procedural grounds.
When Are Customs Fines Typically Imposed?
- The declared value doesn't reflect the actual sale price
- Errors in the declared origin or tariff classification
- Missing or incorrect documentation
- Movement of goods in violation of customs regulations
Frequently Asked Questions
What should the objection petition include?
The petition should clearly state the date and number of the fine decision, the grounds for objection, and any supporting documents.
Is the fine collected while the objection is pending?
A timely objection generally postpones the decision becoming final, but this should be assessed based on the specific circumstances.
What is the deadline to file a lawsuit?
The deadline to file with the tax court is generally 30 days under the relevant legislation, but since the starting point and application can vary by case, we recommend confirming with a lawyer.
