The Legal Process for Cryptocurrency Fraud: How to File a Complaint
As cryptocurrency markets have grown more popular, fraud carried out through fake investment platforms, "double your coins" schemes, counterfeit wallet applications, and fraudulent exchange websites has increased just as quickly. Most victims, after losing their funds, do not know which authorities to contact, what evidence to gather, or how realistic their chances of recovery actually are. This article explains the legal process that can be followed after falling victim to cryptocurrency fraud.
How Does Cryptocurrency Fraud Differ From Ordinary Bank Transfer Fraud?
In classic bank transfer fraud, the movement of money is traced through interbank records and the access that MASAK (the Financial Crimes Investigation Board) and judicial authorities have to the banking system. Cryptocurrency transactions are somewhat different: because the blockchain is a public ledger, transfers to a wallet address and that address's subsequent movements can, in technical terms, be tracked. However, this traceability does not mean the funds will be recovered. Identifying the real person behind a wallet address usually depends on the identity-verification records held by the exchange where the transaction took place, and on that exchange's cooperation with investigating authorities. When the exchange is based abroad or operates outside any regulatory framework, this cooperation can become significantly more difficult.
Which Offenses Come Into Play? An Assessment Under the Turkish Penal Code
Cryptocurrency fraud cases primarily fall under the offense of fraud regulated in Article 157 of the Turkish Penal Code (TCK). Where the act is committed by using information systems, banks, or credit institutions as a tool, it may qualify as aggravated fraud under TCK Article 158, which increases the applicable penalty. Depending on how events unfolded — for example, where unauthorized access is gained to an exchange account or wallet — the offense of unlawful access to or interference with an information system under TCK Article 244 may also come under separate consideration. Which offense applies in a specific case depends on the precise nature of the conduct.
Why Is Immediate Notification to the Exchange Important?
As soon as fraud is discovered, it is advisable to notify the cryptocurrency exchange to which the funds were sent or transferred without delay. The exchange can be asked to freeze the relevant account and, where possible, block the balance. Cryptocurrency asset service providers operating in Turkey are subject to certain obligations under the relevant legislation and are expected to take suspicious-transaction notifications into account. However, if the funds have already been withdrawn from the exchange or moved to other wallets, this step may have limited effect.
Filing a Criminal Complaint With the Public Prosecutor's Office and the Investigation Process
The victim may file a criminal complaint with the Public Prosecutor's Office of their place of residence or where the offense was committed. In practice, such complaints are typically referred to the Anti-Smuggling and Organized Crime (KOM) or Cybercrime units of the provincial police departments. During the investigation, blockchain analysis and digital forensics expertise may make it possible to trace the transactions; however, this is not a guarantee that the funds will actually be recovered. The outcome largely depends on whether the identity of the suspect can be established and on the exchanges' cooperation with the investigation.
MASAK Notification and the International Process for Foreign Exchanges
Where a transaction raises a suspicion of money laundering, filing a notification with MASAK (the Financial Crimes Investigation Board) is a route that may be worth considering. If the exchange used in the fraud is based abroad, gathering evidence and corresponding with the competent authorities may require recourse to mutual legal assistance (MLAT) procedures. It should be kept in mind that these processes can take a long time, depending on the legislation and level of cooperation of the country concerned.
What Should You Pay Attention to When Gathering Evidence?
- Keep complete records of wallet addresses and transaction hash (transaction ID) details
- Take screenshots of exchange account activity (deposits, withdrawals, transaction history)
- Preserve all correspondence with the suspicious person or platform (WhatsApp, Telegram, email)
- Obtain payment receipts and bank/credit card statements
- Record the promised returns, platform name, website, and advertising links

The exchange itself is generally not the perpetrator of the fraud but merely the platform where the transaction took place. However, a claim that the exchange failed to exercise due diligence may be a separate legal matter to assess; processes involving foreign exchanges may require international judicial cooperation.
How much time do I have to file a criminal complaint?
The statute of limitations for fraud offenses is governed by TCK Article 66 and varies depending on the nature of the offense. That said, filing the complaint without delay is strongly advisable so that evidence remains fresh and the funds can still be traced.
Does notifying MASAK speed up the criminal process?
A MASAK notification can be a useful step for assessing a possible link to money laundering, but it is not, by itself, a guarantee of a criminal investigation or of recovering the funds.
